60 Days Late—Mortgage defaults
The lender may now consider the loan in default after 60 days, under the mortgage terms.
Before a lender can file a foreclosure in New York, if your mortgage is for a home you live in, the lender must send you a 90-day pre-foreclosure notice (require under RPAPL §1304). This gives a full 90 day window of opportunity to try to work with your lender to find an alternative to foreclosure.
This Notice will include:
• The amount due
• The lender's contact info
• A list of HUD-Approved housing counselors
• A statement that you have 90 days before a foreclosure case can be filed
This is NOT the same as being served, it is a required warning letter, not a court document. For 90 days the lender can not take any legal action. This is sent by certified and first-class mail, not hand delivered by a process server. At this time no court has been involved, there's no case number or legal filling.
